11:30 am
say that you going to do the last transaction at three and everybody out at 3:30 and going to trust you and if this gentleman is your spokesperson and not working there at night we are going to go to you if you are on staff. and if the inspector goes there they will look for the responsible party. so we don't want to hear that i am just the guy that you know speaks english better or whatever. and he is not even there and he is speaking for you people. i just want to make sure that you understand that if we do this, that means that whatever he is not the fall guy, you know? whoever is manager on that duty is going to be the fall guy. so what you are telling us to give us something in good faith and we are now saying something whereas there is a trust issue here and so do we want to go in and give you that trust to 3:30? that is the big debate right now. >> all right. is there any other questions?
11:31 am
>> okay, why don't you have a seat. >> thank you. >> i am opening the floor, please, thank you, sir. push >> good evening, commissioners, i'm officer mike tores representing captain garity. >> we recommend approval for this application from 2:00 a.m. to 3:00 a.m. with the conditions that you just mentioned earlier. and i would like to read some of the calls for service that we have had for the last two years briefly so you kind of have an idea of what has been doing on at this location. the first one is, this is february 16, 2011, and this was at 2:00 a.m.. and i will read you the cad briefly. inside of naan-n-curry
11:32 am
restaurant. a concern about an agent x. let's see. it says, that she is disoriented, took her into the restaurant and bought some items and she has been acting weird. this was february the 16th, 2011. this is march the 25th, 2011. this is an assault that occurred. and it says, a group of asian males, females, harassing, and tried to hit her and that is in march. >> what time was that? >> this was at 9:00 in the evening. >> there is another cad report, this is october 27th, 2011. at 6:00 p.m.
11:33 am
they had a trespasser at naan-n-curry. >> we have january 1st, 2012. and this is at 4:00, 4:44 in the morning. and the cad reads, naan-n-curry 8:11, intoxicated subjects outside, possibly waiting for rp to come out to start a fight. subjects are five indian males and one female. in clothing, no weapons seen. >> another incident that happened, this is march 24th and this is 3:17 in the morning. and the cad reads, rp in a verbal with the manager playing
11:34 am
music too loudly inside the restaurant. and that was at 3:17 in the morning. and then, you have june the 10th, 2012 at 3:20 in the morning and the text reads, rp calling regarding under aged customer at naan-n-curry. rp did not know which naan-n-curry but stated that it was the main one downtown. let's see. and i have a noise complaint, this is july the 21st, at 3:21 in the morning, news, and the cad reads, san francisco hilton, rp, loud music coming from 1020, means the location, from naan-n-curry. and this one is from july 27,
11:35 am
2012. this is at 2:44 in the morning. and we have let's see, this is just a person calling about this place here. we have another trespasser. this is july the 27th. and this is at 2:30 in the morning from naan-n-curry. and then we have another trespasser, and this is 3:00 in the morning. and let's see, it says, inside naan-n-curry a male being aggressive with other customers. and this one is september 2, at 2:30 in the morning, the cad reads, 30 people inside, fight, trespasser, and it reads a female caller. and these are mostly males fighting inside the restaurant.
11:36 am
and like i said, this is at 2:30 in the morning. another cad called. this is 4:21 in the morning and this is september the second. and the cad reads, wireless call from verizon, naan-n-curry but it sounds like there is a problem inside. and then gave a couple of street names, there was a fight inside naan-n-curry. subjects involved and they left the restaurant. this was at 4:20 in the morning. >> i think that we get it, thank you so much. >> i just have two more here. >> all right, go ahead. >> and two last and of course you have october the 7th, this was at 2:30 in the morning i guess two employees got into it, they were fighting with each other. and then the last one, you read that one, also, this was
11:37 am
october 28th and this was at 2:27 in the morning and the cad read, several hundred in front of the restaurant rushing the door, numerous fights, breaking out in front of the inside of the restaurant and only one person was attempting to hold back a crowd at only opening entrance. >> so based on these calls for service, we think that it is only fair to allow the applicant to get this permit for one hour, from 2:00 a.m. to 3:00 a.m.. >> thank you, very much. >> thank you. >> floor is open to public comment on naan-n-curry. >> i'm david baker. acting president of the northa market planning coalition and as old and sick as i am, i am here today to see what mr.
11:38 am
rehman looks like. i have never heard such hypocracy in all of my life. he has a slum property at 308 turk. it is deplorable. i would say that it is the worst apartment building in the tender loin, it has had absolutely no maintenance and i would invite all of you to take a look at it. and i'm afraid that mr. rehman whether it is naan-n-curry or 308 turk, is part of the problem. so, hope that you will take the over all view into consideration and extending mr. rehman any favors. >> thank you, very much.
11:39 am
>> thank you. >> any other public comment? >> seeing, none, public comment is closed. >> so, commissioner, for the discussion, we don't have further discussion, i would entertain a motion. >> i mean, i definitely... >> i don't want to make a motion. i just wanted to just tell you what i would like the motion to contain and then we can talk about it. i would like to entertain the motion that would specifically say that the last meal is served at 3:00 a.m. in the morning. that they can have their extended hours sunday through thursday to 3:00, friday and saturday to 3:30. and friday and saturday, the last meal was served at 3:00 a.m.. on sunday, to thursday, the last meal is served at 2:30. that their security must be
11:40 am
trained and guard carded and to conclude the police conditions along with our good neighborhood policy. and commissioner akers has another thing to add for whoever is going to make the motion. >> the motion the condition that they have clearly posted hours. >> okay. so who wants to make... >> the motion are 1, 2, 3 and then on the back four and five which are to two security guards from 12 a.m. which is not one, but 12 to 3. >> all right and the camera. >> 12 to 3:30. >> right. >> 3:30. >> i have a question as to can we require that there are ropes out there to control the issues since they have problems with fighting and that way there
11:41 am
could even be you cannot be past this point because we will not be able to serve you because we are closing. >> stantions? >> yes. >> outside a rope to control the crowds as well as a posting that says once you get to this point we will no longer serve you because you are not going to get in by three. >> a suggestion, not to try to operate this business as a commissioner, but to instruct them as to the end result that you are looking for and so if there is a way that you could turn the condition that you have just described into something that is more along the lines of a general statement regarding the end result. >> okay. >> and have them operate the business. >> okay. so on the two security guards, i mean could we require them that one has to stay at the front obviously for their liquor license they have to check the ids and possibly they have to search people.
11:42 am
>> 47, right? >> it is wine and beer. >> right. >> and they are responsible to clear up as abc requires that no alcohol at all, even on the tables at 2:00 a.m. so i think that if the security guards is at the door they will be the ambassador to let people know that they can't come in it is passed. >> i just want to say that the night that i was there, people were walking in and i saw several female customers and a guy walking in carrying alcoholic beverages in plastic glasses clearly it was alcohol, they had limes in them and stir and you let people into your place carrying hard liquor and it was after 2:00 in the morning. so, that is a problem for me as well. >> commissioners, just for the record i have a copy of their conditional liquor license, which only allows them to serve alcohol to 1:00 in the morning,
11:43 am
not 2:00 in the morning. >> i see. okay. >> so someone has to, i want to entertain a motion that has all of this in it, so who do you think could do that or i could say it and somebody could say so moved. >> you could say it >> all right. so, we would like to entertain a motion... >> commissioners i apologize. i was just informed that if it is possible for perhaps security to stay probably a half hour or more like to 4:00 in the morning. >> good point. >> to have the people leave, thank you. >> good point. >> okay. >> so this motion is or should be that we grant the extended hours permit sunday through thursday to 3:00 in the morning. last meal served at 2:30.
11:44 am
security to be on hand from midnight to 3:30 a.m. and friday and saturday extended hours to 3:30 in the morning, last meal served at 3:00 with security on to 4:00 a.m. music to be kept no louder than an ambient sound so that there are no sound complaints and that your hours are posted clearly. that you have two security guards at all times that are both lead and guard card trained. what am i forgetting? >> and the police conditions. >> and the three neighborhood visits, sent here in writing by the end of february. >> and... >> okay.
11:45 am
>> so moved. >> the camera, surveillance. >> and the camera surveillance. >> that is part of the police conditions, all of the police conditions. >> commissioners? somebody needs to. >> so moved. >> and seconded? >> second. >> could i make a comment? >> sure. we get applications like this for extended hours all of the time and i think that we count on good businesses to act well if you are going to get this permit. i think that there is a lot of distrust that you are hearing from the commissioners because it feels like you know if we offer this it is actually a right but it is also a privilege because we get a lot of push back from neighbors and the police department to say no, don't... close everything down at 2:00 but we know that there are people that need the service and need to sober up so we want to make sure that people that are going to go to your facility are safe and make sure that they are actually being you know being or that you are accountable what we are
11:46 am
asking for. so, you know i will vote for this, but we have to make everyone as an example when it comes to extended hours here. and in my time in the commission that it is important that good businesses run good after-hour businesses thanks. >> commissioners, just for clarification, when you say, sound needs to be kept at an ambient level, as i am the guy checking that, are we saying that no sound audible outside of the establishment? >> absolutely. >> and you should keep your doors shut without closing up the roll up door for safety. that door, i drive by sometimes and that door is wide open all of the time. >> yeah and i just want to say that i hear a lot of passing the buck thing and we started this business ten years ago and we didn't know. it is a business owner's responsibility to create the business and learn the laws and follow them. it is not the community's job to police them and if you have
11:47 am
a very good understanding of the neighborhood and the tender loin then certainly you know how many community groups are in the area and just passing the buck is very little hope that 3:30 is going to work. >> okay. >> mr. king? >> commissioner akers? >> aye. >> commissioner hyde? >> aye. >> commissioner tan? >> aye. >> lee? >> aye. >> joseph. >> aye. >> good luck to you, don't violate this permit. i mean, don't. no excuses. thank you. >> commissioners? i have to take my leave, i'm doing the christmas tree down stairs i just got texted twice, and they need me. so i am going to pass the bevel off to commissioner hyde. >> commissioners if we are moving on to item number, 1.
11:48 am
so is there any public comment, this is time for the public to come in and address the commission on issues that are not on our agenda? >> seeing none, public comment is closed. are we doing the report and all of that number two. >> they are continuing that. >> okay. >> okay. >> so, the police department comments are next then. >> so, let's do number two, if you wish. >> which is the executive director's report. >> okay, i thought that was being. that is why i asked. >> i think that i said yes. >> okay. so, we are going to number two, our report from the executive director. >> thank you >> everybody all taken care of in the room. all right. i actually don't have a report for you. but i need some order in this meeting. no, i am just kidding.
11:49 am
we have seen you all recently and not a lot happened because it was a holiday, this building was closed for some time. and the only thing that i did want to mention is that at this point, i believe based on the e-mails and communication with everybody that we may not have a quorum on december 18th. so, i have to contact with mr. king for sure to make sure that we don't have anything in depositcy in terms of canceling them but that is probably the likely scenario, so if anyone has a problem with that let me know. and then that means that we will not see you until january, so merry christmas to you all. are you ready? >> commissioners, i will keep this short. you will see on your sheet again, just as director stated it is thanksgiving and so traditionally thanksgiving usually people come home from college or school and spend time with their family and eat
11:50 am
too much and drink too much and get into trouble. but this past thanksgiving weekend we actually did pretty well. the city was busy but not too busy. and we did not have any major events which was nice. officer from central station is here he has a few things to go over that i will leave to him. and over all, central has actually been pretty quiet and southern has also been quiet with a few hiccups and the mission as this commission knows if you read the paper has been busy due to gang violence we have been working with the gang task force as well as the unit and the mission station to put a little bit more time and resource into the mission over all to head out some of the problems of the past. i think that over all, this is multiagency, and we are seeing traction there and i know that our tiny corner of that particular pie.
11:51 am
we have been out there working it and it has been seeming to go well. and we are going to get a good response from the permitted venues out there and we will continue to do so. i will mention that we will be meeting along with the northern station, with venue owners, next week, polk street and that we will also with the organization and partnership we are setting up another meeting for venue owners on fillmore in the coming weeks as well. so that is where we have had a few problems in both locations so we are heading off those. you can see looking over all at the list, it is pretty short, there are a few high notes there. something that you can... which is something that the officer will go into bigger detail. a robbery on broad way again and an assault. now the assault i think that it is important to mention happened in the morning. why it got brought to our attention is the suspect had
11:52 am
hidden the weapon in the doorway of one of our permanent venues which is why it is on this particular list. but over all that is all that i have currently unless you have questions. >> were they find for these violations? >> no they were not, being as they are not permit violations. until the new legislation passes which gives us the power to site unpermitted venues, we cannot permit them. the good news is that you just permitted them, now we can... all we want. >> thanks. >> okay, thank you very much. we are moving on to number 3,... >> i know that this is solely based on... >> is there any public comment? >> sorry. >> seeing none. >> thank you. >> we are going to move along to number three, the police department comments and questions.
11:53 am
>> good evening, commissioners and staff, central station, steven mathiason we were expecting more incidents over the thanksgiving weekend it is usually a spike there but it was not and we are happy to say that did not occur. as far as different incidents in the district on december second there was a street robbery with guns at 571 broad way that is right near center folds. five males approached two victims and robbed them right on the street and they fled the area and there is a pending investigation. december second, at 9:30, the victim had her cell phone stolen. and december second at 2:00 a.m., the victim had her cell phone stolen from the roof at the ruby sky. and december third at 2:00 a.m.. three suspects were arrested at
11:54 am
the cellar for being drunking and resisting arrest. after being object jected by security they gestured that they had weapons and a fight ensued in front and on the street. the police were called and the subjects were taken into custody and booked at county jail. november 18th at 1:30 a.m. the victim had the iphone stolen from fiddler's green on columbus and the last one to note is on november 23rd at 10:30, a victim had her purchase stolen located at the condor on broad way. any questions or comments? >> thank you. >> is there any public comment on the police report? seeing none, we move to number 6, which is new business requests and future agenda items. >> i am going to skip number
11:55 am
five, is there any commission comments or questions? >> just a minute. i am having a hard time tonight. >> let's go back to commissioner comments and questions. >> we are going to invite everyone to the 11th at monroe, it is a north beach neighborhood holiday party that gale gilman and i have set up. there will be food and cocktails. and a drag show. and the music will be provided by dj who is his... >> carnitas, and so it will all be vinyl being spun that night. >> what date? >> that is the 11th from 6 to 9. >> and i got one, next monday, semac christmas party opened to
11:56 am
industry members and friends and a toy drive for sfpd operation dream which is run by the fire department. so, it is free with a toy. and come and meet the other district policemen and permit officers. >> what is the date? >> the 10th. december the 10th, monday, 6:00, messanine. >> you have no holiday parties? >> i have... they are private. >> you are not invited. >> and it is the end of the my an calendar too. >> the exclusive bryant tan. >> that is it. concludes our commissioner comments and questions. and now, let's go on to new business request for future
11:57 am
agenda items. >> have we heard from supervisor chu's office about coming and speaking to us about his legislation? >> no. >> well, we... i made the request last week through his staff and i think, jan but she has not indicated a time frame yet. it is most likely january before this is going to actually move forward. so given a little space and we have felt it belt best to come and address the commission. >> next year. because this, again, is this train is on the track but it is going rather slowly. so we will have time to weigh in. >> what is the deal on western soma? >> western soma is moving forward. i believe that there is a good
11:58 am
chance that different plans for the 11th street corridor will be adopted, what they are is not official yet so i would not want to speculate but i think that we have a good chance of having been heard. >> no more public or no more meetings? >> the meeting of the commission is thursday. >> the planning commission is this thursday. >> is thursday. >> and that is like the final planning commission meeting and that then goes to the board of supervisors. >> got it. >> okay. >> all right. >> all right. so, i can wish you all a happy holiday and i close this meeting of the entertainment commission. >> we are all done.
11:59 am
